Étude des difficultés juridiques inhérentes à la présence d’une copropriété dans ses relations avec les tiers

Abstract : Governed by the law of 10 July 1965, and its implementing decree of 17 March 1967, the condominium is now well defined. Indeed, concerning both its organizational and administrative aspects, this legal structure complies with strict rules that must be respected. A condominium does not exist in isolation, and must necessarily form relationships, contractual or not, with third parties. However, it’s clear that the presence of such a structure is a source of complexity within the organization and management of these relationships, the currently applicable legislation seems to know the limits. In fact, the special law of condominiums leads to a good many rules of common law being ignored and, under these circumstances, it’s certain that the workings of, the administration or management of, a condominium don’t always go in favor of third parties. The example is also evident in terms commonly referred to as "condominiums in a difficult situation". Therefore, knowing that condominiums represent about a quarter of French housing, now is the time to increase awareness of these problems, and seek solutions.
