Vers une gestion optimale et homogène sur l’ensemble du territoire national des superpositions naturelles de propriétés

Abstract : The identification and the management of the natural overlappings of properties establish constitute real stakes in land subject. We find the latter in cliffs limestones in border of sea or stream, but also for cave dwellings or still subterranean cavities for diverse operations. Indeed, this type of property made the object of numerous studies by the profession of land surveyorexpert without succeeding in finding of homogeneous solution applicable to the whole national territory. Problems of responsibility, in particular in case of collapses or of flows of waters, end in issues, between private and public owners, which the land surveyors-experts have to answer in judicial expertise. So, in this context, it seems necessary to find an optimal mode of management of the phenomenon. This solution will exist thanks to a legal think on the existing proposals on the subject as well as on the definition of innovative proposals. The subject raises the question of the definition of the property but also the question of the management of the natural environment.
