Le blessé de guerre à travers l’expertise médico-légale, de la pension militaire d’invalidité à la jurisprudence Brugnot : une étude épidémiologique sur l'Afghanistan de 2005 à 2013

Abstract : Introduction : the purpose of the study was to describe the french soldier wounded during external operations throughout the specificities of medical expertise in armed services invalidity pension or in common law (named "Brugnot") since 2005. Material and methods: Retrospective study, from 2005 to 2013, of expertises realized by 2 medical evaluators in South-West Land Forces/Army Zone, on soldiers wounded in Afghanistan. Results : 89 patients (95 expertises) were included. The common profile was a 30 year old man, married with children(s), A-level, paratrooper in an operationel unit of land forces. The wounds were mostly due to explosive devices, with "blast" mechanisms, causing shrapnel wounds with an uniform anatomic distribution. Analysis of Brugnot expertises founded high consolidation period, non-existent former condition, high sustained suffering, minor disfigurement and sexual harm, high frequency of agreement prejudice, and various treatments of the others heads of damage. The aftereffects founded a high frequency of PTSD and ENT pathologiqes. The comparison of invalidity rates between invalidity pensions and Brugnot founded more "positive" rates in the former, but less people indemnified because of the minimum threshold. Conclusion : the recent evolution of the french military compensation system, based on common law, has yet to homogenize the practice of medical expertises, as to guarantee the victims an equal and adapted treatment of their wounds in action, in the service of France.
