« Quand naître n'est pas encore exister » : éhique et réanimation néonatale des extrêmes prématurés : quelle place pour les parents dans la prise de décision ?

Abstract : Purpose of the study: Bring together different perspectives which feed the controversy about the role of the parents in the decision of resuscitation of extreme premature in neonatal intensive care units. Materials and method: This study was conducted according to the methodology of controversy analysis. 44 documents from 86 different authors were analysed, using a reading grid for data analysis, then classified into two distinct tables. The selected documents cover a period from 1986 to January 2016. Results: The conditions for continuing or stopping intensive care deeply changed, in particular since the Léonetti Law of April 22nd, 2005. In the framework of this law, collegiality and role of the parents in decision-making were deeply developed. However, according to several authors, the involvement of parents in the decision challenges the medical responsibility and induce noxious effects on the parent’s psychism. They may not be lucid enough to make a rational decision. For others, on the contrary, it allows parents to exercise their parenting and to look for the child’s best interest. Conclusion: Extreme prematurity and progress in neonatal resuscitation raise permanent ethical and legal dilemmas. The study highlighted the fact that no Cartesian response can be given regarding the place of parents in the decision-making process. The study makes it possible to observe that over the years the controversy changed, amplified, attenuated and metamorphosed. Will it be closed ever?
