La loi du 5 juillet 2011 : étude observationnelle des mainlevées d’hospitalisations sans consentement par le juge des libertés et de la détention à Charles Perrens

Abstract : The law of the fifth of July, 2011 plans the systematic intervention of the JLD said « control by rights » to rule on the extension of a hospitalisation without consent beyond fifteen days, deadline decreased twelve days by the reform of September 27th, 2013. He can order a withdrawal on the shape (external legality) or on the content of the measure (internal legality). Our work consists of a study led on the Charles Perrens’ hospital and centered on all the 79 withdrawals of hospitalisations without consent pronounced within the framework of the control of the full right from August 1st, 2011 till August 1st,2016. 79 inclusive patients are 44-year-old on average and for more than half of them, it is about single women, with a high educational level, working in a normal environment. 40,5% of the inclusive patients suffer from humor disorders and 30,4 % of the patients are reached by psychotic disorders. The collection of the prescriptions motivated by the JLD reveals a majority of withdrawals on motives for « shape » (60,1 %). 93,4 % of these withdrawals were acquired after September 2013, date of the reform of July 5th, 2011. It is mainly about procedural irregularities (85,4 %) and more particularly of a disrespect of deadlines granted (defect of production of one of the certificates or medical notices), or 29,2 % of the cases of external illegality. On the other hand, 40 % of withdrawals are justified by an internal illegality. Among these, the support of the patient in the care proposed in hospital worker and/or the absence of proof of its incapacity to be agreed to the care, is the motive most frequently used by the JLD (60 %). In near half f the cases, the obtained entraine withdrawal the end of the complete hospitalization but more than a third of the patients remain all the same hospitalized freely. A complete and regular training of the healthcare professionnals and the administration staff on the law of July the 5th, 2011 is necessary to limit the wit hdrawals of « shape ». The not insignificant proportion of withdrawals on the « bottom » underlines the importance of the quality of the medical certificates, the only medical support on which the JLD can lean.
