La prescription acquisitive et les personnes publiques

Abstract : Acquisitive prescription allows a possessor to acquire property law on things, not only when its possession is exempt from vice (discontinuity, violence, clandestinity, equivocal), but also after a period of 10 or 30 years. However, in 2008 the article 2227 of the civil code offering to Public persons the prescribe capacity, has been suppressed. Moreover the law proposition of 2014 which aimed to drive the private domain imprescriptible. One of the study’s goal is to know if acquisitive prescription could benefit today to Public persons or could be opposed to them. In practice, the possession’s conditions should be examined and particularly the estates extend on which the possession is concerned (condition often overlooked in theory, but decisive).
