Le bornage et la prescription acquisitive

Abstract : Boundary making and prescription are rights concepts that relate, more broadly, to property laws. They are currently debate within the French chartered surveyors’ national institution that seeks to solve the consideration of the prescription in the demarcation process, main activity of the chartered surveyors. Boundary making define the formal limit of private landed property, contrary to prescription carries property law’s transfer by possession. In front of this visible difference, we wonder how, and to what steps, these concepts, theoretically distinct, they can overlap in practice? The essay in question intend to answer at the previous issue by developing a reflection that highlights the different theoretical and practical facets of demarcation process and adverse possession. Besides, this essay take part in debate to argue on the chartered surveyors’ possibilities to consider prescription during demarcation process.
