L’indemnisation des servitudes de passage dans leur établissement et leur aggravation

Abstract : The statutory right-of-way easement applies "when a fund does not have any exit to a path opened to public traffic, or has only an inadequate outcome in view of the use that is done, its owner can get on one or more neighbouring, in return for compensation funds, the establishment of a passage to put an end to the situation of enclave" in the application of section 682 of the Civil Code. Easements of passages are the source of many disputes and litigation, particularly when the compensation for prejudice is not satisfactory for either party. There is a very high appeal to define an indemnification in order to compensate for damages caused by the easement to the servient tenement. It is the same for crossing easements established by title. It is therefore appropriate to ask what criteria it is possible to build in order to estimate compensation and whether the methods used so far are the more organisationally This thesis aims to provide answers to questions that may ask the experts themselves furthermore it may assist experts in opening up procedures. Moreover it also provides interesting concepts and practical informations for all people facing an easement.
