La propriété communale : recensement, enjeux et gestion pérenne

Abstract : The municipality, currently the smallest administrative entity in France, has possessions which characterised by property and ownership. Litigation relating to determination of the property’s status of the public person connected to two characteristics to be defined: case and demarcation of boundaries. The case in public domain is in theory simple by basic criteria of “CG3P” but many exceptions and particular judicial document drive this case complex. The demarcation of “CG3P” is in contradiction between private domain and public domain. For private domain, the procedure takes into account opinion for and against whereas for public domain, the demarcation is always unilateral. Distinctions between things which constitute the municipality property are not always based and actual. Arranging of tools and methods is essential to make the difference between all different municipalities property.
