Les litiges au pavillon odontologie : revue de morbi-mortalité

Abstract : Like the entire public service of AP-HM, the odontology department is not immune to claims, complaints, or legal actions from dissatisfied patients. A good understanding of patient’s motivations, grounds for claims, and potential solutions to avoid them, seems to be more and more a necessity, on the one hand, to manage well the potential claims that may arise in the hospital environment, and especially on the other hand, to avoid them by the implementation of preventive action in order to limit the consequences of these litigation’s processes. In response to this issue, we should first define the nature and the forms that these claims and litigations may take.In a second part, we will detail through some examples, the current handling of these claims and litigation, first during amicable conciliation and in case of failure of it, by a legal process before administrative courts. Finally, in a third part, will be proposed some preventives actions to avoid these disputes.
