La régularisation des débords aériens causés par l’isolation extérieure

Abstract : The context of the study was envisaged by the nature of the activities carried out within a surveyor’s office from Paris, solicited numerous times a year, to advise its customers on the convention to be elaborated to provide legal viability for an overflow of building on funds belonging to third parties. These requests were reinforced in the context of the energy transition law of 17 August 2015, which stipulates that any private residential building whose consumption exceeds 330 Kwh of primary energy per m² per year must undergo an energy renovation by 2025. In addition, since May 30, 2016, the realization of thermal insulation must be carried out in case of renovation work. The owners realize an exterior insulation which can lead to an overhang on the fund of a third when the insulation is done in limit of ownership. 60 In order to supervise and secure these overflows, the office proposes the realization of an agreement with the third parties concerned in association with the legal actors (notaries, lawyers, syndic ...). The current agreements proposed by the office and the different actors are a legal uncertainty in case of examination by the judge. This study focuses on legal solutions to regulate air overflows. The objective is to ensure long-term survival by limiting the requalification of the outer insulation in encroachment.
