L’hospitalisation en soins psychiatriques en cas de péril imminent : SPI : une mesure hors du cadre "exceptionnel" pensé par la loi : évaluation rétrospective de la conformité de la mesure avec le cadre prévu par la loi au centre hospitalier Alpes Isère

Abstract : The French law regarding the involuntary hospitalization has been modified by the law of July 5th, 2011. This law authorizes the involuntary hospitalization, without third party and on the sole basis of a doctor's certificate, implementing the psychiatric treatment in case of imminent peril (IP). This procedure has boomed in the past years, exceeding the exceptional character foreseen by the law. The purpose of this doctoral thesis is to study the conformity of the IP measure with the legal text, through a study carried out at the Centre Hospitalier Alpes Isère. We have carried out a descriptive, retrospective and monocentred study on all patiens hospitalized within the framework of IP between March 1st and July 1st 2017 at the CHAI, in full-time hospitalization.The study has been focused on the conformity of the measure facing the mention of IP and the traceability of the search for a third party in the initial doctor's certificates and the 24-hours-certificates. 78 files have been analysed. Regarding the main purpose, the IP procedure is conform in 88 % of the cases, a third party beeing unavailable or non mobilizable. In 12 % of the cases, the procedure is not conform, a third party was available but had not been contacted. Regarding the secondary decision criteria, 82 % of the IP measures have been maintained by the Judge of Freedoms and Detention (JLD), independently of the conformity of the measure and only 4 % have been withdrown by the JLD, then on form and not on substance.
