Expertise psychiatrique pénale pré-sentencielle chez le sujet état limite accusé d'homicide volontaire : revue de la littérature et enquête auprès des experts de la Cour d'Appel d'Aix-en-Provence

Abstract : Criminal psychiatric assessment ensures a balance between justice and psychiatry and is currently experiencing a difficult period due to a drastic drop in expert demography and the increasing burden placed on experts, whose differences in their conclusions are criticized. Homicides and homicide attempts are common in France, and some authors with serious mental disorder giving rise to an abolition or an alteration of the discernment respectively benefit from criminal irresponsibility or mitigation of responsibility. Borderline personality disorder is common and characterized by a strong tendency to acting out. Few of works concerning its position in the homicidal act and expertal considerations in terms of responsibility and dangerousness are available. By focusing on a limited context, that is the pre-trial criminal psychiatric assessment of borderline persons accused of murder, we did a research amid experts of the Aix-en-Provence court of Appeal, allowing us to confront the literature's data with the daily practice. Interviewed experts had the same definition criteria but different theoretical conceptions of borderline personality disorder. The expert disagreements mainly concerned the medico-legal implications (qualification of the relationship between disorder and offense, differential diagnosis with psychopathy, evaluation of criminological danger and alteration of discernment, consequences of the paragraph 1 and 2, penal-imposed care). These divergences seemed to be related to bias and personal conceptions in connection with their theoretical training as well as a lack of knowledge of the recommendations concerning assessment.
