Le droit sud-coréen des étrangers : multiplicité des régimes utilitaires et inefficacité des droits fondamentaux

Abstract : The number of foreigners residing in South Korea is steadily increasing, so as the number of news items related to foreigners: the arrival of hundreds of asylum seekers to the Jeju Island, the domestic violence endured by foreign wives… All of these cases are linked directly or indirectly to the question of the rights of foreigners. What kind of rights do the foreigners possess in South Korea? Are they all entitled to the same rights, or at least, to a fundamental protection according to their fundamental rights? The translation and analysis of a few laws, decrees and decisions concerning the rights of foreigners revealed the existence of multiple utilitarian regimes leading to the integration of an elite, on the one hand, to the temporary use of foreign labor, on the other hand, and finally, to the forced assimilation of marriage migrants. Far from offering a real fundamental protection, the South Korean judges seem to repeat the discriminatory regimes for the foreigners in a regular situation, deny the effect of fundamental rights for the foreigners in an irregular situation, and limit in practice the refugee law for the de jure foreigners, but also for the de facto foreigners, the North Koreans, who cannot benefit from this law.
