Les copropriétés en difficulté et le rôle du géomètre-expert

Abstract : While the number of condominium units is increasing and that the proportion of condominiums in difficulty is high, accounting 107 000 fragile co-ownerships, we need to concern ourselves with the fate of these condominiums. Are the dedicated legal mechanisms sufficiently effective ? Do the mechanisms created by the public authorities allow to resolve the difficulties by avoiding the judicial treatment ? Despite the recent legislative and regulatory developments on this subject, there are so many constraints. Confronting the limits of the legal or amiably treatment of difficulties of condominium, what role can the surveyor play to anticipate the difficulties ? Indeed, when it is complex to heal, it is necessary to prevent in advance. How the legal and technical abilities of the surveyor allow him to anticipate future problems ? That he is the author of the legal organisation of the condominium or manager as a co-ownership trustee, the surveyor must to act in various areas to avoid the birth of the condominium difficulties.
