Quelle légitimité de la transgression pour une décision médicale éthique ?

Abstract : The proposal of this study is to show that transgression occupies a special place in medical decision-making. This "special place" is not, in our opinion, to be placed in the category of chaos or disorder, or even insubordination or dissidence, but it is a meeting place, often a negotiation between various motivations which come into tension and sometimes unravel in choices which, if they reflect a certain irregularity, are not for all that devoid of ethical significance in terms of the aim they pursue and the legitimation they display.
In the present work, we propose to define transgression and to define its conceptual field in the medical decision. We explore the nature, function and production of medical norms as well as their purposes in order to question the notion of ethics in order to probe its close relationship with transgression.
In fact, transgression would be correlative to a much larger subject that brings into play an irreducible dichotomy between the conception of ethics and its implementation (reality pinciple), the rational, the real, and the reasonable, between theory and practice.
