La restriction de la liberté d'aller et venir des résidents présentant des troubles cognitifs en EHPAD : quelles limites ? Quels enjeux éthiques ?

Abstract : The increase in the number of elderly people and the consequences of old age are impacting our society and forcing us to rethink it, particularly in the field of health and in the care of vulnerable elderly people.
An ethical reflection on the guarantee of respect for the fundamental rights of the elderly seems, the time, necessary. The maintenance at home of these having a limit, the Residential Facilities for Dependent Elderly People (EHPAD), are welcomed elderly people more and more dependent, with an increase in people suffering from cognitive and behavioral disorders. It becomes, then, more and more difficult to strictly apply the respect of individual freedoms in nursing homes which are, by definition, organized for the collective. Nursing homes, under the responsibility of their director, must guarantee their residents respect for their fundamental individual rights and freedoms, including, in particular, the freedom to come and go, but also, ensure collective security.
The major challenge for these structures is, therefore, to succeed in reconciling two apparently opposite principles (freedom of movement and security) by taking into account the uniqueness of each person and by providing a response adapted to his vulnerability.
The purpose of this research work is to apply an ethical reflection on the practices of health professionals in nursing homes that result in a deprivation of the freedom to come and go of certain residents, more particularly, suffering from cognitive disorders and to find an acceptable compromise and involving a safe balance between freedom and limited risk.
