Le respect du contradictoire est-il dématérialisable dans l’acte foncier réalisé par le géomètre-expert ?

Abstract : The purpose of this work is to study the adversarial principle dematerialisation in the land deed produced by the chartered surveyor. This principle is a trial guiding principle and a very important part of the elaboration procedure of this deed. It includes in particular the convocation of the parties, the adversarial debate and the signing of the land deeds. However, the number of absences during demarcation meetings is increasing related to numerous second homes on the coast, which limit the application of this principle. Dematerialisation is a solution to these difficulties, which has been used by several professions for some years now. Surveyors go little by little to the digital, in particular with the implementation of the electronic signature in their Géofoncier platform, with an objective of systematic dematerialization in the long term.
