De l’esprit commun à la « personnalité d’ordre supérieur ». Une pensée des institutions sociales chez Husserl

Abstract : This dissertation aims at studying and elaborating the premises of a phenomenology of institutions based on the Husserlian concept of "higher order personality". This being irreducible to any other types of communities : the couple, the friendship, the family, the people, etc, it will be our goal to determine the fundamental structure of such a specific social configuration that is the institution and, correlatively, to question the specific modality of the instituted being-together. Starting from the birthplace of this concept, the Ideen II, the texts On Intersubjectivity (Husserliana XIII, XIV and XV) and more precisely the texts Gemeingeist I and II, we will focus on it as the unitary social configuration resulting from a multiplicity of individual persons gathered around an enduring community of will, made possible by a community of communication, and crystallised within a juridical unity. Finally, we will ask the question of the practical realisation in which the will of the higher order personality and those of its members are embodied. By relying on an isomorphism of the categories of the individual and the social, we will defend that this concept makes it possible to account for the unity of the institution without sacrificing either the unity of the latter or the individuality of its members. This concept, which emerges from the urgency of a return to the original and unitary meaning of institutions, should make it possible, by understanding institutions as units of meaning constituted from within, to provide the means for a return to the constitutive meaning of the institutional community. As a result, this work allows to consider the internal questions of the phenomena of personal intersubjectivity. Thus, it allows to approach phenomenologically the subjects of moral and political philosophy such as citizenship, right, duty, culture, history or ethics. Finally, it also opens up questions about Europe and humanity, which will occupy Husserl more and more in his later texts.
