Entreprise en difficulté et statut coopératif

Abstract : The notion of firm in difficulty is a particularly wide notion recovering the domain of the collective procedures but also the precautionary measures.The cooperative corresponds to a typology of company with a specific status where mix values and completely atypical principles (principle of double quality, principle of democracy, …). When cooperatives are confronted to difficulties, they are submitted to the bankruptcy law. However, their guiding principles will have incidences during this procedure which we suggest analyzing in. We shall evoke the diverse cooperative principles and their incidences during the various stages of the implementation of collective procedure or amicable procedure. The analysis of these specificities will be made by putting in confrontation three law : the co-operative law, the company law and the bankruptcy law. It will be brought to us to notice that, although not formalized by the legislator, the specificities of cooperatives in difficulty are, in the practice, undeniable.
