Le rôle de la diplomatie non gouvernementale dans la mise en oeuvre des compétences de la Cour Pénale Internationale : l'action de plaidoyer de Human Rights Watch pour lutter contre l'impunité de Jean Bosco Ntaganda en République Démocratique du Congo

Abstract : The creation and the enforcement of the International Criminal Court in 2002 embody a turning point within the international legal system, characterizing a running process to reach a universal justice. To be able to enforce its legal competence, this institution requires the cooperation of states. Nowadays, 109 states have accepted to concede a part of their sovereignty to the ICC, however, as a matter of facts, the states are still reluctant to the complete enforcement of the ICC's competences. Human rights NGOs, as actors of the non governmental diplomacy, act as proxy between the states and the ICC to promote the Court, and above all, to lead to an end the reign of impunity, that still prevents the accountability of many international criminals. Through a fight for international justice, Human Rights Watch has established a strategie advocacy that targets media and decision makers to urge the states to direct their practices and their priorities to a higher respect for justice and human rights. As a concrete example of these trends that take place in the international system, this analysis focuses on the advocacy of Human Rights Watch to fight the impunity of Jean Bosco Ntaganda. Accused by the ICC of war crimes in Democratie Republic of Congo -the ICC delivered an arrest warrant against him, he has not been arrested and is benefiting from the protection of the DRC authorities.
