La réduction de volumétrie

Abstract : For about forty years, the property business has been using volumetry in the implementation phase of urban projects. However, no legal text would regulate this type of property division. Only recently did volumetry started being considered with the ALUR law of March 24, 2014. Yet, this law only partially addresses all of the alternatives offered by volumetry. Indeed, article 28 creates the opportunity to the split condominium volumes. Splitting a property complex into volumes, another issue related to volumetry, is the principle according to which a volume stem from division is removed from the condovolume. This method is used in alignment procedure as well as building permits. To be implemented, building permits and licences constraints should be analysed as well as the hypothesis of a land division. Furthermore, reducing volumes needs to be done by adhering to ground urbanism regulation. However, this regulation only takes into account the land,not the volumes. Through the practice, land surveyor professionals and other experts have theorized in order to legalize the splitting of a property complex into volumes. However, everybody involved in real estate hope there will be no legal limitation in order to maintain a certain freedom.
