Le droit de la copropriété des immeubles bâtis, une solution adaptée aux enjeux des bailleurs sociaux ?

Abstract : Social housing landlords have been obliged to sell a part of their rental property portfolio due to the decrease in government financing following the 2018 Finance Act. Some of their housing will therefore be subject to a co-ownership system. Indeed, social housing landlords find themselves having become co-owners, since they rarely sell all of the housing units comprising their buildings. This co-ownership system results in the sharing of decisions among co-owners, a process that is scarcely compatible with the social housing landlord’s usual method of independent management. Social housing landlords would therefore be well advised to involve themselves in the drafting of the co-ownership documents as soon as the co-ownership has been established, so as to take into account their needs, especially in terms of management. Furthermore, once the co-ownership structure has been set up, social housing landlords can take an active part in co-ownership management by developing a managing agent activity.
