Difficulté d'évaluation des souffrances endurées chez le patient décédé avant la date de consolidation dans les expertises pour les commissions régionales de conciliation et d'indemnisation des accidents médicaux, des affections iatrogènes et des infections nosocomiales‎ : à propos d'une série de 36 cas

Abstract : The "Kouchner Law" of March, 4 2002 concerning the rigths of the patients and the quality of the health system created the Regional Commissions of Conciliation and Compensation (RCCC) responsible for compensating the victims of medical accidents, of iatrogenic affections or of nosocomial infections. When the RCCC is called for, it entrusts an expert a mission whose one point consists in estimating the prejudices of the endured pains. When the victim dies rapidly, before the supposed date of the consolidation, it is impossible to estimate the pains in a reliable and recurring way by using the existing scales. It goes against the principle of recurrence of expertise. This count of prejudice should not be estimated anymore in that case.The heterogeneousness of the estimation of the sufferings has a harmful effect on what the entitled beneficiaries feel about them and puts the expert in an embarrassing situation. There are other means for those beneficiaries to obtain compensation :
- By using two counts of prejudices created by the Dintilhac nomenclature : The prejudice of affection that compensates the pain of the family caused by the loss of a beloved being. The prejudice of assistance that compensates the disorders of a relative's life when nursing the victim.
-Thanks to the prejudice due to the loss of chances of survival resulting from jurisprudence : Acknowledging that with the death of the victim his/her life expectancy disappears alltogether.
- By creating an inclusive compensation like the specific one given for the post - transfusional contamination by the AIDS virus.
Thus, one could imagine a " specific prejudice of death "
