Les outils de divisions et de gestions immobilières pour répondre aux exigences de mixité sociale

Abstract : The social housing organizations have a mission of general interest : build and manage social rental housing. In order to promote social and urban diversity, they design with private developers joint operations. But how to divide a real estate opération of this type? What are the specific constraints of social lessors in terms of management of the rental park? Technical and legal tools to divide a building are limited. The condominium law and airspace subdivision are most commonly used by housing agencies in joint operations. We will see that there are many tools such as the condominium association secondary, the macrolot or the special common parts to help meet the requirements of social lessors. But a new system involving private real estate developers and social housing organizations was born: the social rented usufruct. Its recent application is to follow... The property management following subdivision is a major concern for social lessors. The condominium status or management of the airspace subdivsion by a collective organization are the solutions adopted. But what are the advantages and disadvantages of these property management methods for social housing organizations?
