Les pièces optionnelles, non exigibles ou superfétatoires d'un permis d'aménager : analyses et conséquences

Abstract : Several possibilities can be considered concerning the ownership, administration and maintenance of roads, open spaces and amenities on housing estates in France. When roads, spaces or amenities are created, developers are granted the liberty of creating their own building, town planning and local community rules. If this is indeed the case, they must determine the document in which these choices will be written up. The history of the housing estate, the coexistence of public and private law, the uncertainties of texts on the subject and habits complicate choices and the forecasts for their consequences. This study presents different courses of action, analyses the specificities of each document and the modes of evolution for well-informed decision-making.
