Les enjeux pour le géomètre-expert des interactions entre bornage et servitudes

Abstract : The easements are a notion of the right of property abandoned by many surveyors because of their tendency to generate litigation. In addition, these professionals specialist in the land delimitation through the boundary, do not always see the value of using these real rights because they can’t create them themselves. This is probably the neglect which multiplies the neighborhood conflicts about easements. Yet even if the boundary can’t really define a property or any other real right , the consequences with regard to easements are not less. The surveyor could take part in the life of easements when providing services to improve the protection of the parties but also to optimize the use of these real rights that are easements. Moreover, despite the perpetual nature that can have a bounded limit, the possession has a major role in the evolution of land especially in boundaries themselves or real rights constituted around. However, his guarantor status in the definition of land limits gives him a privileged place to act during these land plot or legal changes, before the litigations.
