Représentation et vécu des procédures judiciaires en médecine générale

Abstract : Introduction: The number of judicial proceedings in France against general practitioners has been growing steadily over the last twenty years, whether civil, administrative, criminal or ordinal. Objective: Exploration of the personal experience of general practitioners involved in legal proceedings, but also the professional impact and the level of knowledge of doctors in the management of the risk of adverse events and the judicial system. Method: Individual, semi-directed and anonymous interviews with ten volunteer doctors practicing in Upper Normandy and Ile de France. The recruitment was done step by step. The analysis was done by qualitative and retrospective method after verbatim transcription of the data. Results: The ten doctors interviewed all felt isolated and all showed very strong feeling of anger, fear, shame, but also sadness, sometimes going as far as depressive syndrome. Following their involving in a procedure, doctors practice a defensive medicine, which can have deleterious consequences for the patient. Knowledge of the judicial system and management of adverse events is insufficient. Conclusion: Preventing legal procedures involves reducing the risk of adverse events associated with care; control systems and training on management risk are to be developed at the collective and personal scale. The development of psychological and legal support structures dedicated to physicians is an essential point to break the doctor’s isolaton and improve their experience when involved in a legal proceeding.
