Les dérogations au champ d’application de la loi du 10 juillet 1965 applicables aux immeubles à vocation tertiaire et de commerce : opportunités, risques juridiques et freins aux évolutions

Abstract : When it was created in 1965, condominium’s status was applicable to all built-up buildings or groups of built-up buildings whose property is divided into lots by several persons. After fifty-five years of existence, this principle is relaxed and the scope no longer concerns, since June 1st 2020, buildings or groups of buildings built for the total or partial use of dwellings, the ownership of which is divided into lots among several persons. This imperative field’s reduction comes within the framework of the entry into force of the provisions of the ordinance to the ELAN law of October 30th 2019. This development creates new prospects for the businesses or offices oriented buildings management. It is necessary to analyze all the ins and outs of this change in order to be able to propose secure and lasting legal arrangements.
