La dimension volumétrique des servitudes de passage

Abstract : Historically, rights of way, whether legal or conventional, have always been defined in planimetry. But, today, with the densification of buildings, the existence of a right of way can have a significant impact on the possibilities of building and on the valuation of land. The objective of a volumetric definition of the site of a right of way in the deed of constitution is multiple. The major stake of such a definition in the acts is to pacify the relations between dominant and servient land while admitting more flexibility in the exercise of the rights of way. Moreover, is to allow urban densification by legally framing the possibilities of construction for the servient land overhead and underground area of a right of way.
